Nashville Man Fatally Shot After Alleged Assault and Threats; Self-Defense Claim Under Investigation

Nashville Man Fatally Shot After Alleged Assault and Threats; Self-Defense Claim Under Investigation

NASHVILLE, TN — A fatal shooting early Sunday morning is under investigation after a 19-year-old man claimed self-defense following a violent confrontation inside a residence on Denise Drive.

According to the Metropolitan Nashville Police Department, the incident occurred around 3 a.m. when a group of friends returned home from a birthday celebration. Maurice Blackmun, 39, reportedly physically assaulted a family member outside the home before turning his attention to Adrian Harvell, 19, who attempted to intervene.

Witnesses stated that after the initial altercation, everyone went inside the home, where Blackmun confronted Harvell again. Reports indicate that Blackmun placed Harvell in a chokehold before following him into the living room, allegedly issuing multiple threats of violence against Harvell and other witnesses.

Harvell, in response, drew a handgun and demanded Blackmun back away. When Blackmun did not retreat, Harvell fired a single shot, striking and killing him. Blackmun was pronounced dead at the scene.

At this time, no charges have been filed against Harvell. The Metropolitan Nashville Police Department has confirmed that the case will be reviewed by the District Attorney’s Office once the investigation is complete.

Self-Defense Considerations

While Tennessee law allows the use of deadly force in self-defense, the specifics of this case will determine whether Harvell’s actions meet the legal standard. The absence of a weapon in Blackmun’s possession could raise questions about whether the threat he posed justified a lethal response. However, the reported physical assault, the use of a chokehold, and verbal threats could factor into a “disparity of force” argument, which considers whether an unarmed attacker could still cause significant harm or death.

As this case develops, it serves as a reminder of the importance of understanding self-defense laws and the factors that can influence legal outcomes. Firearm owners should be well-versed in their state’s use-of-force statutes and consider training that includes de-escalation and situational awareness.
