RANCHO BERNARDO, CA — A jewelry store owner in Rancho Bernardo fired a warning shot into the ceiling to thwart a brazen smash-and-grab robbery attempt at Kay’s Jewelry Designs late Thursday afternoon. The incident occurred just before 5 p.m. at the small, family-owned business, leaving the owners shaken but unharmed.

According to reports, the suspect, who was masked and clad in black clothing with distinctive red gloves, entered the store armed with a hammer. Without uttering a word, he began smashing glass display cases and grabbing jewelry, seemingly unfazed by the store owners’ presence. Store co-owner Rose Zarabi recalled how her husband, Kamiyah Zarabi, fired a warning shot from a handgun when the suspect ignored her pleas to stop.

The shot startled the would-be robber, causing him to abandon the stolen goods and flee the scene on foot. While the store suffered damage and lost merchandise, no one was physically injured in the confrontation.

This incident highlights the significant risks and potential legal implications associated with firing warning shots. Although no charges are expected to be filed against Mr. Zarabi, such actions can often lead to unintended consequences. Warning shots, while sometimes effective, can pose a danger to bystanders, create additional property damage, and could potentially escalate the situation.

Moreover, from a legal perspective, warning shots may be scrutinized under laws that govern the use of deadly force. In many jurisdictions, firing a gun, even as a warning, can be interpreted as the use of deadly force. The primary legal standard for the use of such force is that it must be necessary to prevent imminent danger of death or serious bodily harm. If authorities believe that the threat did not meet this threshold, the individual firing the warning shot could face criminal charges.

Firearms should be used to stop a threat, not to scare it away. The goal should be to neutralize the immediate danger rather than to intimidate or issue warnings. As demonstrated by this incident, while the warning shot effectively ended the robbery, it also opened up the possibility of legal repercussions and safety risks.

For those who carry firearms for protection, it is crucial to understand the legalities and responsibilities involved in using deadly force. Proper training and a clear understanding of when and how to use a firearm are essential for anyone who may find themselves in a self-defense situation.

In this case, the Zarabis were fortunate that the situation ended without injury. However, the incident serves as a reminder of the complexities surrounding defensive gun use and the importance of knowing the law and practicing responsible firearm handling.
