Federal Judge Overturns Illinois Semi-Automatic Firearm Ban

A federal judge has overturned Illinois’ ban on semi-automatic firearms, citing recent U.S. Supreme Court rulings upholding Second Amendment rights. Illinois’ Attorney General plans to appeal as the 30-day injunction hold period begins.


SPRINGFIELD, IL (2-minute read) — A federal judge has overturned Illinois’ ban on certain semi-automatic firearms, including AR-15 rifles, as well as large-capacity magazines, following recent Supreme Court rulings that strictly interpret the Second Amendment.

Judge Stephen P. McGlynn, of the Southern District of Illinois, issued a permanent injunction against the ban, though the order will not take effect for 30 days, allowing time for the state to file an appeal.

The Protect Illinois Communities Act, signed in January 2023 by Governor J.B. Pritzker, aimed to ban certain semi-automatic firearms and accessories in response to the 2022 Independence Day mass shooting in Highland Park, where a lone gunman killed seven people and injured dozens. The law quickly faced resistance from gun rights advocates and legal challenges, arguing that it infringes upon constitutional rights.

In his opinion, Judge McGlynn emphasized the fundamental nature of Second Amendment rights, referencing recent Supreme Court decisions that have strengthened the right to bear arms. “Sadly, there are those who seek to usher in a post-Constitution era where citizens’ individual rights are only as important as they are convenient,” McGlynn wrote, opposing the notion that constitutional rights are subject to changing societal standards.

Attorney General Kwame Raoul promptly filed a notice of appeal to challenge McGlynn’s decision in the U.S. Court of Appeals for the Seventh Circuit, stating confidence that the law would ultimately be upheld.

Erich Pratt, senior vice president of Gun Owners of America, voiced approval of McGlynn’s decision, asserting that Illinoisans have a right to choose their means of protection without government interference. “We the people deserve the right to decide how best to protect ourselves,” Pratt said.

With McGlynn’s ruling now pending an appeal, the outcome could impact similar firearm restrictions and Second Amendment cases nationwide.
