A 12-year-old boy in Milwaukee, WI, who fatally shot a 32-year-old during an argument on December 14, has been cleared of criminal charges by the district attorney, citing self-defense in protection of his mother.


MILWAUKEE, WI (1-minute read) — A self-defense incident unfolded in Milwaukee when a 12-year-old boy fatally shot a 32-year-old man during an argument near 51st and Hadley on December 14. Authorities reported that the incident arose from a domestic altercation in which the child acted to protect his mother.

The Milwaukee County District Attorney announced on Thursday that the boy would not face criminal charges, deeming his actions an act of self-defense.

The man who was shot was taken to a hospital but later succumbed to his injuries. The DA’s office explained that the evidence corroborated the boy’s account of defending his mother during the altercation. As the law provides protections for individuals acting in defense of themselves or others, the decision to forego charges was deemed appropriate.

It was not immediately clear who possessed the firearm that was used in the self-defense shooting.

This case highlights the complexity of self-defense laws, especially when minors are involved. While tragic, it underscores the importance of understanding legal protections for self-defense, as well as the consequences of domestic disputes escalating to violence.

Safety Tip: Teach children the importance of de-escalating conflicts when possible and ensure they understand firearm safety, especially if a firearm is present in the home.
