FLOCK CAMERAS RULED UNCONSTITUTIONAL in Major Federal Case

The video analyzes a federal district court ruling in United States v. Kyle, where Judge Sara E. Hill found that a deputy’s warrantless access to approximately 30 days of cross-state automated license plate reader data violated the Fourth Amendment. The court distinguished a lawful initial traffic stop from the deputy’s later extension of the detention, finding that ordinary factors such as luggage, nervousness, rental-car use, and travel patterns did not establish reasonable suspicion. It also held that aggregating numerous public plate observations into a detailed historical record of a person’s movements constituted a search because it intruded on privacy in the whole of those movements. The resulting evidence was suppressed, but the ruling is limited to a federal district court and does not prohibit all license plate readers or create a nationwide ban.
