A New Era For The NFA: GOA And Silencer Shop Execute First Unregistered Suppressor Transfers Since 1934

The Brief:

Gun Owners of America and Silencer Shop completed the first legal transfer of firearm suppressors without federal registration since 1934. This event in Leander, Texas, followed a court ruling that struck down National Firearms Act registration requirements after a new law eliminated the associated manufacturing and transfer taxes.

The new procedure replaces the lengthy federal registration process with standard background checks identical to those for traditional firearms. This change specifically affects federal mandates, though buyers must still adhere to state-level restrictions and verify local dealer compliance before completing similar over-the-counter transactions.

LEANDER, TX — A 92-year-old pillar of federal gun control crumbled in the early morning hours of August 13, 2026. At 12:01 A.M. CT, moments after a seven-day judicial stay expired, Gun Owners of America (GOA) and lead plaintiff Silencer Shop formally executed the first transfer of firearm suppressors to private citizens without submitting ATF Form 4 registration paperwork or entering the items into a federal registry database.

The historic transaction took place at Silencer Shop’s storefront in Leander, Texas, with key figures in attendance including U.S. Representative Andrew Clyde (GA-09), GOA Senior Vice President Erich Pratt, Texas Congressional District 23 candidate Brandon Herrera, and Texas State Representative Wes Virdell (HD-53).

The Statutory & Judicial One-Two Punch

The historic transfer was the culmination of a two-stage legislative and judicial strategy targeted at the National Firearms Act of 1934.

  1. The Legislative Foundation: Congress enacted the GOA-backed One Big Beautiful Bill Act, which officially reduced the manufacture and transfer tax on suppressors, short-barreled rifles (SBRs), short-barreled shotguns (SBSs), and “Any Other Weapons” (AOWs) to $0.
  2. The Judicial Injunction: Because the Supreme Court ruled in Sonzinsky v. United States (1937) and NFIB v. Sebelius (2012) that NFA registration requirements are constitutional solely as an exercise of Congress’s taxing power to raise revenue, zeroing out the tax stripped the NFA of its constitutional foundation.

In Silencer Shop Foundation v. ATF, U.S. District Judge James Wesley Hendrix ruled that without an underlying tax, the federal government lacks the constitutional authority to mandate registration, Form 4 submissions, or months-long waiting periods.

Formal Notice to ATF and Midnight Transfer

Prior to conducting the transfer, legal counsel for GOA, Silencer Shop, Herrera, and Virdell formally served written notification to the U.S. Department of Justice (DOJ) and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) declaring their intent to complete the unregistered transfers immediately upon the expiration of the court’s temporary stay.

With no objections or emergency blocking orders issued by federal authorities prior to the deadline, Silencer Shop processed the suppressors for Herrera and Virdell. The items were transferred in full compliance with standard federal and state firearm purchase procedures—requiring a standard Form 4473 and a instant NICS background check, identical to purchasing a standard long gun or handgun.

“GOA fought to crush the NFA’s unconstitutional restrictions through the One Big Beautiful Bill, but we didn’t stop there. We promised to keep fighting until these restrictions were gone, and now our members are putting the historic victory into action. The era of federal registration for constitutionally protected arms must end.”

— Erich Pratt, Senior Vice President of Gun Owners of America

Industry and Leadership Reaction

Leaders across the firearms industry and advocacy space echoed the historic nature of the Leander transfers:

  • Brandon Herrera: “I’m happy to once again be working with Gun Owners of America to help be the tip of the spear fighting for gun owners, constitutional rights, and civil rights of not only Texans, but all Americans.”
  • Dave Matheny (Founder & CEO, Silencer Shop): “This is a huge victory, but we still have a long way to go; and Silencer Shop will continue to lead the way alongside GOA, FRAC, ASA, Silencer Shop Foundation, and the many other groups who are working to unwind the NFA.”
  • Jamin McCallum (Founder & CEO, Palmetto State Armory): “Today marks more than the first NFA-free suppressor transfer under this injunction, it marks the moment years of fighting became real for the American people.”
  • Wes Virdell (Texas State Representative): “What was once considered unachievable is now a reality, because of Gun Owners of America and Silencer Shop. GOA never gave up the fight to get here.”

Tactical & Legal Context: What Buyers Need to Know

While the Leander transfer marks a historic precedent, buyers and firearms retailers must navigate the practical application of this injunction carefully:

Metric Pre-Injunction NFA Process Post-Injunction Injunction Process
Transfer Application ATF eForm 4 required Standard ATF Form 4473
Federal Registry Serial number entered into NFA Registry No entry into federal registry database
Background Check ATF NFA Division specialized processing Standard NICS background check at FFL
Tax Stamp $0 (since Jan 2026) $0
Wait Time Days to months Instant / Same-Day (upon background approval)

Safety & Compliance Advisory: While federal registration enforcement is currently enjoined for protected parties under the court order, buyers must remember that state-level restrictions remain fully active. Suppressors remain completely banned under state statutes in 8 states and Washington D.C. Furthermore, local FFLs must wait for official administrative guidance or ensure they fall directly within the covered class of protected plaintiffs before completing over-the-counter transfers without Form 4 documentation. Always verify local dealer protocols and state statutory compliance before taking physical possession of an un-registered platform.
