A Broward County judge has dismissed manslaughter charges against 29-year-old Brittany Brothers, ruling she is immune from prosecution under Florida’s Stand Your Ground law. The case, which stemmed from a fatal shooting during a “gun game” in Hollywood, fell apart after the judge determined the State failed to disprove Brothers’ claim that she fired in fear for her life.


HOLLYWOOD, FL (3-minute read) — The legal battle surrounding the 2022 death of a Hollywood man has come to a sudden halt following a significant ruling in Broward Circuit Court. Judge Tim Bailey dismissed a manslaughter charge against Brittany Brothers, citing Florida’s Stand Your Ground law, which provides immunity from prosecution if a person reasonably believes deadly force is necessary to prevent death or great bodily harm.

The incident occurred during what was described as a “gun game,” where Brothers and her boyfriend allegedly pointed firearms at one another. According to court records, Brothers claimed that her boyfriend pulled the trigger on his firearm first, exclaiming, “This b—- almost went off,” before she responded by firing her Glock. Defense attorney Ken Padowitz argued that Brothers, a victim of repeated domestic violence, acted out of a genuine fear for her life.

The Burden of Proof and Procedural Failures

Judge Bailey’s order emphasized that the State of Florida failed to meet its “clear and convincing” burden of proof to disprove the self-defense claim. A major blow to the prosecution’s case was the exclusion of Brothers’ initial interview with police. The judge threw out the evidence because detectives had handcuffed Brothers and questioned her without providing a Miranda warning, violating her constitutional rights.

While the Broward State Attorney’s Office plans to appeal the ruling to the 4th District Court of Appeal, the current dismissal underscores the strength of Florida’s immunity statutes when the State cannot definitively disprove a defendant’s subjective fear. For defense experts, the case serves as a stark reminder of how investigative errors can lead to the total collapse of a criminal prosecution.

Safety Tip: The concept of a “gun game” is a catastrophic violation of the four fundamental rules of firearm safety, including: always treat every gun as if it is loaded, and never point a firearm at anything you are not willing to destroy. Firearms are life-saving tools, not toys or props for social interaction. Engaging in such behavior not only risks a tragic loss of life but also places you in a legal “gray zone” where even a justified defensive shot can lead to years of harrowing litigation.
